What should I do if I am outside of the U.S. and need to get my prenup notarized?

You can notarize online with HelloPrenup if you have an SSN/ITIN or US residential address. These requirements, such as having an SSN/ITIN or U.S. residential address, are essential for secure identity verification and compliance with U.S. laws and regulations, ensuring that the signer's credentials are securely confirmed during the process.

If you are in the US, you may go to a local in-person notary, such as at a UPS to have your prenup notarized in person, even without SSN/ITIN or US address.

If you do not have any of those things and are unable to get to the United States before the wedding to have your prenup notarized, then you have three options:

  1. Have the prenup notarized at a US embassy located in your current country, or

  2. Have the prenup notarized at a foreign notary and then have it later authenticated by a US notary (this could also be at a US embassy or a notary located in the US).

  3. Try a different online notary provider that accommodates international signers or does not require SSN/ITIN for identity verification.

Note: You can have your prenup notarized separately from your partner.

Why does this matter?

  1. Notarization helps deter arguments for fraud around signing a prenup (if your future spouse ever challenged your prenup, having a prenup notarized helps your argument)

    1. Some states require notarization as a mandatory step, and without it, the prenup is automatically invalid.

  2. Make sure this is done before the wedding (prenups signed and notarized AFTER the wedding are invalid).
