Why do we each need Representation for a Washington Alimony Waiver?

There is no requirement in Washington to have an attorney when the terms of the prenup are fair and reasonable to the party who doesn’t want it to be enforced. However, if the court deems the terms to be unconsionable (i.e., unfair or one-sided) to the party who doesn’t want the prenup to be enforced, then that party must have had independent advice from an attorney for the agreement to be enforceable.
